Scottish Widows Pension Calculation Tools [PCT’s] are intended to provide a general guide to the financial adviser on a range of pension allowances and benefits. In addition, general reports are supplied by the PCTs to provide an estimate of the options available to your client, based on certain assumptions you make. Please be aware that actual returns may differ from the results produced by the PCTs. The reports produced by the PCTs should therefore only be used as a general guide to assist in pension planning for your clients. In addition, specific suitability can only be confirmed if you have followed your own regulated sales advice process. You must be satisfied that the assessment of the client circumstances is fully discussed and agreed with the client.

The figures provided by the PCTs are not guaranteed, but have been designed to show possible outcomes based on the inputs provided and assumptions made by you. The actual level of any return will depend on the actual performance of the specific investment made, together with the tax treatment and actual charges of each specific product. The figures provided by the PCTs either make no, or very approximate, allowances for the tax status of individual clients and must not be regarded as personalised or accurate. By your use of the tools, you acknowledge and agree that we are not giving any warranties in respect of the tools, the information produced by the tools or their use, and that all warranties that may be implied by law are excluded insofar as it is possible to do so.

The PCTs are for financial adviser use only and are not intended for private customer use. Private customers should not rely on any information contained in the tools or information/outcomes produced by them. Financial advisers should only use the tool as part of a regulated selling and advice process.

By your use of the tools, you acknowledge and agree that Scottish Widows and its third party supplier will not be responsible for:

  • any assumptions made by you for the purposes of data input into the PCTs
  • any assumptions made by you regarding investment growth rates and charges
  • any assumptions made by you regarding taxation
  • any advice or recommendation made to your clients as a result of the outcomes generated by the PCTs
  • any assessment of the client’s appetite for accepting investment risk
  • determining the suitability for your client of any outcomes generated by the PCTs

You acknowledge that the services may not be accessible when needed and that information transmitted over the Internet may be subject to interception and modification by third parties.

You shall: (a) not obtain or attempt to obtain access to or interfere with any programs or data of ours; (b) not attempt to reverse-engineer, decompile, translate, disassemble or separate the components of the PCTs; (c) ensure that the customer data will not contain anything which infringes third party rights, is libellous, indecent, obscene or defamatory. Except as is set out here, or as is otherwise permitted by law, you shall not use, sub-contract, sub-license or resell the PCTs.

Scottish Widows and its third party supplier will not be liable for any claim that may be made by any client of yours relating to your use of the PCTs, and you agree to indemnify and hold Scottish Widows and any third party supplier harmless for any claim that may be made by any of your clients or their legal representatives.

It is your responsibility to ensure that all necessary consents have been sought and obtained from your client for their personal data to be used on the PCTs in accordance with the Data Protection Act.

Please ensure that in using the PCTs with your client, they are fully aware of, and understand, the above information.

These Terms & Conditions shall be interpreted in accordance with Scots law and you agree to submit to the jurisdiction of the Scottish courts in relation to all matters arising from your use of the tool.
